(速報)イラク戦争への任官を拒否したワタダ中尉、軍法会議で無罪の模様
「イラクで行われている大儀の無い不道徳で違法な戦争には指揮官として任官できない」と命令を拒絶したかどで軍法会議にかけられていた米陸軍のワタダ中尉が無罪になった模様。

Lt. Watada's case ended in a mistrial. Ehren has not been found guilty and his attorney Eric Seitz thinks it is unlikely the case will be re-tried. A new trial has been scheduled to begin on March 19 – the Fourth Anniversary of the Invasion of Iraq - the judge couldn't have given us a better day to organize against the illegal war and occupation!

ニュースレターを簡単に読み直してみる
id:artane:1170998493 で取り上げた、イラクへの任官拒否のかどで軍法会議にかけられていたワタダ米陸軍中尉に関しての記述ですが、
- 軍法会議が無効なのでやりなおせ。と言う命令が軍事裁判所の方から出されて3月19日から再度審判することになった
- ワタダ中尉の側では（支援者も含めて）裁判を無効にするような請求を一切しておらず、（今回の軍事法廷での）「無罪・裁判勝利」と言う宣言を標準時2月8日の18:28（日本時間2月9日03:28）に行った。
と言う事が主観を排した流れですが、ワタダ中尉とその支援者は「事実上の無罪宣告である」*1と言う風に言っており、実際そのあたりの「読み」ははまちがいないでしょう。
そもそも、ワタダ中尉の主張は「そもそも、アメリカのイラクへの進軍*2と治安維持での駐留自体が合衆国憲法などの諸法に違反した不道徳窮まりない違法な行為であるのだから、米国の憲法を守る事が最優先の義務である米国軍軍人として、法秩序を遵守するために任官を拒否する」と言う物でした。
そうである以上は*3、特に憲法に遵守することを厳密に行うアメリカの司法の立場上（と言うか裁判官の立場としては）有罪にしようがない。と言う辺りなのだと思います。
憲法を始めとする法律で定められている人権や義務よりも地方の条例や行政命令が優先されるどこかの国の最高裁のかたがたに爪の垢でも煎じて飲ませたいものですね。
